Terms of Service

These Terms of Service ("Terms") govern your access to and use of WildFireCost™ (the "Service"), operated by Smart Technology Investments LLC ("Company," "we," "us," "our"). By using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By accessing or using WildFireCost, you represent that you are at least 18 years old, have the legal capacity to enter into these Terms, and agree to comply with them. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

WildFireCost aggregates publicly available federal and state datasets to provide wildfire hardening ROI intelligence, including burn probability, risk percentiles, WUI classification, Fire Hazard Severity Zone tiers, and a cost-benefit analysis of home hardening measures. The Service is informational only.

3. Data Accuracy Disclaimer

Our risk estimates and hardening ROI projections are derived from federal and state datasets (USFS Wildfire Risk to Communities, CAL FIRE FRAP, IBHS, FEMA NRI, BLS CPI, Federal Reserve FRED) that are updated on their own schedules. We do not guarantee the accuracy, completeness, timeliness, or fitness for any particular purpose of data derived from third-party sources.

Risk estimates are probabilistic, not guarantees. A low risk score does not mean a property will not experience a wildfire. A high risk score does not mean a property will experience one. The ROI model uses assumptions about measure costs, insurance discounts, and loss reduction factors that may not reflect actual future conditions.

Always consult qualified professionals -- including licensed contractors, insurance brokers, fire safety consultants, and financial advisors -- before making property hardening decisions.

4. Permitted Use

You may use the Service for lawful personal or commercial research purposes. You agree not to:

• Reproduce, resell, or sublicense our data outputs without a commercial data license agreement
• Scrape or systematically extract data from the Site beyond API rate limits
• Use the Service to discriminate against any person in violation of applicable law
• Represent our data as official government data or as construction advice
• Attempt to reverse-engineer the ROI model or underlying datasets
• Use the Service to harass, defame, or harm any person or entity

5. API Access

API subscribers receive API access subject to rate limits specified in the API documentation. API credentials are non-transferable. You are responsible for securing your API keys. We reserve the right to suspend API access for abuse or excessive usage.

6. Subscription and Billing

Paid plans are billed monthly or annually in advance. All fees are in U.S. dollars and are non-refundable except as required by applicable law or as expressly stated here. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. We may change pricing with 30 days' notice.

7. Free Tier Limitations

The free tier provides county-level hazard scores and is subject to rate limiting. We reserve the right to modify or discontinue the free tier at any time with reasonable notice.

8. Intellectual Property

The Service, including its design, methodology, software, and compiled data outputs, is owned by Smart Technology Investments LLC and protected by copyright and other intellectual property laws. The underlying government datasets are in the public domain. Our original expression, analysis, and ROI methodology are proprietary.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMART TECHNOLOGY INVESTMENTS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Smart Technology Investments LLC and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved by binding arbitration in Los Angeles County, California, under the rules of the American Arbitration Association, except that either party may seek injunctive relief in court to protect intellectual property or confidential information.

13. Changes to Terms

We may update these Terms at any time. We will provide at least 14 days' notice of material changes via email or prominent Site notice. Continued use after the effective date constitutes acceptance of the revised Terms.

14. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice. You may terminate your account by canceling your subscription and ceasing use of the Service.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Smart Technology Investments LLC with respect to the Service and supersede all prior agreements or understandings.
